SFMA Files Motion for Summary Judgment in FGO Lawsuit

South Florida Musicians Association has filed a motion for summary Judgment in its lawsuit against Florida Grand Opera alleging violation of an archival recording agreement. In November 2008, SFMA filed a lawsuit against FGO, alleging that FGO violated an archival recording agreement by posting clips of productions on FGO's YouTube page. SFMA and FGO agree that the facts of the case are not in dispute, and yet FGO has done nothing to move the case forward towards resolution. A summary judgment ruling would be made by the court, without a full trial, based on the merits of the case. Should SFMA lose the motion, the lawsuit would then move to full trial. The judge is expected to rule on the motion for summary judgment by February 2011.
