AFM Pension Delinquency Warning

Please be advised that unpaid AFM pension issues exist with two local area contractors: Sunset Entertainment Group and Miami Symphonic Services.

Despite their claims to the contrary, Sunset Entertainment has not paid pension contributions for musicians since about April 2007. We have been in frequent contact with the AFM-EPF pension fund, and they have repeatedly verified that they have not yet received checks from Sunset Entertainment for the delinquent pension. Sunset Entertainment has signed a Participation Agreement with the Fund valid until 2012 and the pension fund fully intends to pursue collections by any means necessary. We expect that musicians will receive credit for the past due amounts. HOWEVER, we can make no guarantees regarding pension payments for future concerts. If Sunset refuses to make pension contributions for future engagements, it will be the equivalent of musicians receiving an eight percent pay cut.

Despite repeated requests, Miami Symphonic Services has not yet signed a Participation Agreement with the AFM-EPF pension fund. Their previous agreement expired in 2006. Due to federal laws, the pension fund cannot accept pension payments without a signed agreement. For those musicians who performed for Concert Association/American Ballet Theater or Concert Association/Pink Martini in 2008, the pension fund WILL NOT give credit for the pension that has been paid until a signed agreement is received. The fund will also not accept pension contributions for future engagements from Miami Symphonic Services until a signed agreement is received.

We are continuing to pursue both of these issues. Should you have any questions regarding these or other pension issues, please feel free to contact us.
