Sunset Entertainment Ruled Employer of Musicians

In a ruling issued by the Internal Revenue Service on November 13, 2009, Sunset Entertainment and Sunshine Pops have been classified as employers of musicians.

The employers, which previously paid musicians as independent contractors, will now be obligated to treat musicians as employees. The AFM has long held that musicians are employees, and not independent contractors, and this recent IRS ruling reaffirms that belief.

Musicians who have performed for Sunset Entertainment or Sunshine Pops in the past, and would like to re-file federal tax returns to reflect the change in status, should contact the Local.
